Terms of Service

These Terms of Service ("Terms") govern your use of the shopm8 mobile application and related services ("Service") operated by Rappid Engineering ("we," "us," or "our"). By creating an account or using shopm8, you agree to these Terms. If you do not agree, please do not use the Service.

PLEASE READ THESE TERMS CAREFULLY, ESPECIALLY THE SECTIONS ON RECIPES, FOOD SAFETY, ALLERGIES, AND LIMITATION OF LIABILITY. BY USING SHOPM8, YOU ACKNOWLEDGE THAT SHOPM8 IS A SHOPPING ORGANIZATION TOOL AND NOT A SOURCE OF MEDICAL, NUTRITIONAL, OR DIETARY ADVICE.

1. Eligibility

You must be at least 13 years old to use shopm8. By using the Service, you represent that you meet this age requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information when creating your account.
• You may delete your account at any time from the Preferences screen in the app, which permanently removes your data as described in our Privacy Policy.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or the servers and networks that host it
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scrapers to access the Service without our written permission
• Submit content that is abusive, harmful, or infringes on the rights of others

4. Subscriptions and Payments

Free Tier

• shopm8 offers a free tier with limited AI-powered features. Free-tier users are subject to daily usage limits on AI actions such as item categorization and recipe extraction.

Pro Subscription

• The Pro subscription unlocks additional AI actions and premium features.
• Subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store, Google Play Store, or Stripe, depending on your platform.
• Payment is charged to your account at the time of purchase and at the start of each renewal period.

Free Trials

• We may offer a free trial of Pro features. At the end of the trial period, your account will revert to the free tier unless you subscribe.
• Each account is eligible for one free trial only.

Cancellation and Refunds

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until then.
• For subscriptions purchased through the Apple App Store or Google Play Store, cancellations and refunds are managed by Apple or Google according to their respective policies.
• For subscriptions purchased through Stripe, refund requests may be submitted to [email protected]. Refunds are issued at our discretion and generally limited to the most recent billing period.
• We do not provide refunds for partial billing periods or unused portions of a subscription.

Price Changes

• We reserve the right to change subscription pricing. We will provide reasonable advance notice of any price changes. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

5. AI-Powered Features

• shopm8 uses artificial intelligence to assist with item categorization, store assignment, recipe extraction, cooking step suggestions, and substitution recommendations. These features are provided as a convenience and may not always be accurate.
• AI-generated suggestions (such as store assignments, ingredient alternatives, cooking steps, and aisle placements) are based on general data and your personal shopping history. We do not guarantee their accuracy, safety, completeness, or suitability for your specific situation.
• AI outputs can be incorrect, incomplete, or unsafe in ways that may not be obvious. You must use your own judgment before acting on any AI-generated content, especially in ways that affect your health, safety, or finances.
• AI features are subject to daily usage limits based on your subscription tier.

6. Recipes, Cooking Steps, and Food Content

Informational Only — Not Professional Advice

• All recipes, ingredients lists, cooking steps, nutritional information, meal suggestions, substitutions, dietary warnings, and other food-related content (collectively, "Food Content") are provided for general informational purposes only. Food Content is not intended as, and must not be relied upon as, medical, nutritional, dietary, health, or professional culinary advice.
• shopm8 is a shopping organization and convenience tool. It is not a cookbook, dietitian, nutritionist, chef, food safety expert, or medical professional.
• Always consult a qualified professional (such as a physician, registered dietitian, or certified chef) before making decisions that could affect your health, particularly if you have allergies, medical conditions, or specific dietary requirements.

Sources of Food Content

• Food Content may be (a) generated by AI, (b) extracted from third-party websites, social media posts, videos, or user-provided text, or (c) crowdsourced from other users. We do not verify, test, endorse, or guarantee any Food Content from any source.
• When we extract recipes from URLs, videos, or captions (including but not limited to TikTok, Instagram, and web pages), the extracted content may differ from the original source, may be incomplete, may misinterpret ingredients or quantities, and may omit critical safety information. You are responsible for consulting the original source and verifying all details before cooking.

Allergies and Dietary Restrictions

• shopm8 offers optional dietary restriction tagging (e.g., lactose intolerant, gluten-free, nut allergy, vegan, vegetarian, kosher, halal, low sodium). These tags are convenience features based on keyword matching and AI inference, and MUST NOT be relied upon to avoid allergens or satisfy strict dietary requirements.
• The absence of a warning does NOT mean an ingredient is safe for you. Keyword matching and AI cannot identify all allergens, hidden ingredients, cross-contamination risks, trace amounts, or ingredient derivatives.
• If you have a food allergy, intolerance, medical condition, or religious dietary requirement, you are solely responsible for carefully reading all product labels, verifying all ingredients, and consulting a qualified professional. Do not use shopm8 as your sole source of dietary or allergen information.
• Ingredient substitutions suggested by the Service may be inappropriate for your specific situation. Always verify substitutes independently.

Food Safety, Preparation, and Cooking

• Cooking steps, temperatures, cooking times, storage guidance, and preparation instructions provided through the Service may be incorrect, incomplete, or inappropriate for your equipment, ingredients, or conditions.
• You are solely responsible for following proper food safety practices, including but not limited to: safe storage temperatures, correct cooking temperatures to eliminate pathogens, proper handling of raw meat/poultry/seafood/eggs, avoiding cross-contamination, and safe handling of hot surfaces, knives, and kitchen equipment.
• If a recipe, step, or suggestion seems unsafe or inconsistent with accepted food safety guidance (for example, from the USDA, FDA, or your local health authority), do not follow it. Rely on authoritative food safety sources, not on Food Content from the Service.

Nutrition, Health, and Wellness

• shopm8 does not provide medical advice. Any nutritional, caloric, portion size, or health-related content is approximate, not individualized, and should not be used to make medical or dietary decisions.
• Decisions about what you eat, how much you eat, and how you prepare food can affect your health, weight, blood sugar, blood pressure, and other medical conditions. You make these decisions at your own risk and based on your own research and professional guidance.

Your Acknowledgment

• By using any recipe, cooking step, meal suggestion, ingredient substitution, dietary tag, or other Food Content, you acknowledge and agree that (a) you have read and understand this Section 6, (b) you rely on Food Content at your own risk, (c) you are solely responsible for verifying all ingredients, allergens, safety precautions, and preparation details, and (d) Rappid Engineering has no liability for any outcome resulting from Food Content, including but not limited to allergic reactions, food poisoning, illness, injury, weight change, adverse health outcomes, wasted ingredients, or ruined meals.

7. User-Generated and Shared Content

• shopm8 allows users to share shopping lists, recipes, and other content with household members and list collaborators. We do not monitor, review, verify, or endorse shared content.
• You are solely responsible for content you share, and for evaluating content shared with you. Content shared by other users is provided "as is" and is subject to all the same disclaimers that apply to Food Content and AI outputs.

8. Your Data

• You retain ownership of the content you create in shopm8, including your shopping lists, recipes, and preferences.
• By using the Service, you grant us a limited license to process your data as necessary to provide and improve the Service, as described in our Privacy Policy.
• When you share a list with other users via household or list sharing features, your shared content will be visible to those users.

9. Service Availability and Interruptions

• We strive to keep shopm8 available and reliable, but we do not guarantee uninterrupted or error-free access to the Service.
• The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control (including server outages, network issues, or force majeure events).
• In the event of a service disruption, we will make reasonable efforts to restore access as quickly as possible.
• We will post status updates at shopm8.app/status or notify users via email for any extended outages when feasible.
• We are not liable for any loss, inconvenience, or damages resulting from service interruptions, including the temporary inability to access your shopping lists or use AI features.
• If an extended outage affects your subscription period, you may contact [email protected] to request a billing adjustment.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law:

• THE SERVICE AND ALL CONTENT PROVIDED THROUGH THE SERVICE (INCLUDING FOOD CONTENT, AI OUTPUTS, STORE DATA, AND USER-SHARED CONTENT) ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, COMPLETENESS, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
• WE MAKE NO WARRANTY THAT ANY FOOD CONTENT IS ACCURATE, SAFE, COMPLETE, CURRENT, OR SUITABLE FOR ANY PARTICULAR PURPOSE, DIETARY NEED, MEDICAL CONDITION, OR INDIVIDUAL.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• IN NO EVENT SHALL RAPPID ENGINEERING, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY CONTENT PROVIDED THROUGH THE SERVICE.
• WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY HARM, INJURY, ILLNESS, ALLERGIC REACTION, FOOD-BORNE ILLNESS, WEIGHT CHANGE, ADVERSE HEALTH OUTCOME, PROPERTY DAMAGE, FINANCIAL LOSS, OR OTHER CONSEQUENCE ARISING FROM: (a) RECIPES, COOKING STEPS, INGREDIENT SUGGESTIONS, OR SUBSTITUTIONS; (b) DIETARY OR ALLERGEN INFORMATION OR WARNINGS (OR THE ABSENCE THEREOF); (c) ANY AI-GENERATED CONTENT; (d) CONTENT EXTRACTED FROM THIRD-PARTY SOURCES; OR (e) CONTENT SHARED BY OTHER USERS.
• Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the greater of (i) the amount you paid us in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100).
• Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rappid Engineering and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your reliance on any Food Content, AI output, or recipe provided through the Service; or (d) any harm to yourself or others caused by your actions taken in connection with the Service.

13. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or engage in activity that could harm other users or our systems.
• Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (such as Limitation of Liability and Indemnification) will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will first be attempted to be resolved informally by contacting us at [email protected]. If unresolved, you agree to bring any claim exclusively in the state or federal courts located in Delaware, and you waive any objection to venue in such courts.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.
